1. Overview

This website is operated by SE Food Marketing LLC, doing business as SE. Throughout these Terms of Service, the terms “SE,” “we,” “us,” and “our” refer to SE Food Marketing LLC.

SE offers this website, including all information, content, features, tools, products, and services available through it, to you, the user, conditioned upon your acceptance of these Terms of Service and all policies referenced herein.

Our online store is powered by Shopify, which provides the e-commerce platform that allows us to offer and sell products to customers.

By visiting our website, creating an account, placing an order, purchasing a product, submitting information, or otherwise using any part of the website or related services collectively referred to as the “Services,” you agree to be bound by these Terms of Service.

These Terms apply to all users of the Services, including browsers, customers, account holders, vendors, suppliers, merchants, and contributors of content.

Please read these Terms carefully before accessing or using the Services. If you do not agree with these Terms, you must not access or use the Services.

2. Eligibility

By using the Services, you represent that:

  • You have reached the age of legal majority in your country, state, province, or territory;

  • You have the legal capacity to enter into a binding agreement;

  • Any information you provide is accurate, complete, and current;

  • Your use of the Services does not violate any applicable law or regulation.

If you permit a minor to use the Services through a device, account, or payment method controlled by you, you are responsible for that minor’s activity and purchases.

A violation of these Terms may result in the suspension or termination of your access to the Services and the cancellation of affected orders.

5. Products and Services

Certain products may be available exclusively online and may be offered in limited quantities.

We make reasonable efforts to display product descriptions, images, measurements, colors, materials, specifications, and other information accurately.

  • Colors may appear differently depending on your screen, device, brightness, or display settings;

  • Product measurements may vary slightly;

If an ordered product becomes unavailable, we may:

  • Issue a refund for the unavailable item;

We will not replace a product with another product without your consent where consent is required by applicable law.

7. Prices and Currency

Product prices are displayed in the currency selected or shown through the website.

Currency-conversion features may display estimated converted prices. The final amount charged may vary depending on:

  • The checkout currency;

  • Exchange rates;

  • Your bank or card issuer;

  • Payment-provider conversion rates;

8. Pricing and Information Errors

We may correct typographical errors, inaccurate descriptions, incorrect prices, promotions, shipping charges, transit estimates, product availability, or other incorrect information at any time.

If a product is listed at an obviously incorrect price, we may cancel or refuse the order, even if payment authorization has been obtained.

If payment has already been collected for a canceled order, we will refund the relevant amount to the original payment method.

Where appropriate, we may contact you and offer the opportunity to purchase the product at the correct price.

9. Orders

Submitting an order is an offer to purchase the selected products under these Terms.

An order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted or shipped.

An order is generally accepted when:

  • The order has entered fulfillment; or

We reserve the right to refuse, limit, hold, or cancel an order for legitimate reasons, including:

SE is not responsible for delays, delivery failures, additional fees, or lost parcels caused by incorrect, incomplete, outdated, or misleading information provided by the customer.

Address changes cannot be guaranteed after an order has entered processing or shipment preparation.

11. Payments

You agree to pay all charges associated with your order, including:

  • Product prices;

  • Shipping fees;

  • Applicable taxes;

  • Duties or charges displayed at checkout;

  • Other charges you expressly accept.

Payments may be processed by Shopify, Shopify Payments, PayPal, card networks, banks, digital-wallet providers, or other authorized payment processors.

Payment methods may vary depending on your location and checkout availability.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method;

  • The payment information is accurate;

  • You authorize the applicable charges;

  • The transaction does not violate any law or agreement.

Payment authorization may occur when the order is submitted. The final charge may occur when the order is accepted, processed, or fulfilled, depending on the payment provider.

We do not guarantee that every payment method will remain available.

12. Fraud Prevention and Order Verification

We may use internal systems and third-party service providers to identify potentially fraudulent, unauthorized, or high-risk transactions.

We may request documents or information reasonably necessary to verify:

  • Identity;

  • Payment authorization;

  • Billing address;

  • Shipping address;

  • Ownership of the payment method.

Orders may be delayed, held, or canceled while verification is performed.

We will not request full passwords or complete payment-card security credentials by email.

13. Taxes, Customs Duties, and Import Charges

International orders may be subject to:

  • Brokerage fees;

  • Customs clearance fees;

  • Local carrier charges;

SE does not control charges imposed by customs authorities, governments, carriers, or customs brokers.

Refusing to pay customs charges may cause the order to be returned, abandoned, destroyed, or held by customs. Any permitted refund may be reduced by shipping costs, customs charges, return-to-sender fees, handling expenses, or other unrecoverable costs.

14. Shipping and Delivery

Orders may be shipped through internationally recognized carriers, postal services, fulfillment partners, and local delivery providers.

Available shipping methods, estimated delivery periods, and shipping charges may be presented during checkout.

Delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Customs inspections;

  • Carrier disruptions;

  • Weather conditions;

  • Public holidays;

  • Strikes;

  • Transportation interruptions;

  • Incorrect addresses;

  • Failed delivery attempts;

  • High seasonal demand;

  • Government restrictions;

Shipping, tracking, delivery, customs, and undeliverable-order conditions are further described in our Shipping Policy, which forms part of these Terms.

15. Shipping Delays

We will make reasonable efforts to ship orders within the time presented on the website or communicated to you.

If we become aware of a material shipping delay, we may:

  • Notify you of the delay;

  • Provide an updated estimated shipment date;

  • Request your agreement to continue with the delayed order;

  • Offer an alternative solution;

  • Cancel and refund the affected order where required.

Carrier transit delays occurring after dispatch may require an investigation before a shipment is classified as lost.

16. Delivery and Risk of Loss

Ownership and risk of loss are transferred in accordance with applicable law and the terms of the delivery method.

You are responsible for providing a safe and accessible delivery location.

Where tracking confirms delivery, we may require additional evidence before issuing a replacement or refund for a claim that the parcel was not received.

Possible evidence may include:

  • Carrier investigation results;

  • Delivery photographs;

  • Signature records;

  • Confirmation from household members;

  • Confirmation from building management;

  • Police reports in appropriate circumstances.

This section does not limit rights that cannot be excluded under applicable consumer law.

17. Refused, Unclaimed, and Undeliverable Orders

An order may be returned to the sender because of:

  • An incorrect or incomplete address;

  • Failed delivery attempts;

  • Failure to collect the parcel;

  • Refusal of delivery;

  • Unpaid customs duties;

  • Failure to provide required customs information.

If the parcel is returned, we may issue a refund after it is received and inspected.

Where permitted by law, the refund may exclude or deduct:

  • Original shipping charges;

  • Return shipping charges;

  • Customs expenses;

  • Carrier fees;

  • Brokerage fees;

  • Handling costs;

  • Other non-recoverable expenses.

18. Order Cancellations

You may request cancellation by contacting support@sebrand.us.

Cancellation requests are not guaranteed.

An order may only be canceled before it enters processing, fulfillment, or shipment preparation.

Once an order has been processed or transferred to a carrier, you may need to receive it and follow our return procedure.

We may cancel an order before shipment for reasons including fraud concerns, payment issues, product unavailability, pricing errors, shipping restrictions, or violations of these Terms.

Approved canceled orders will be refunded to the original payment method.

19. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Eligible return requests must generally be submitted within 14 calendar days after delivery.

Products must meet the eligibility requirements described in the Return & Refund Policy.

Responsibility for return shipping depends on the circumstances:

  • SE may cover reasonable return costs for approved claims involving an incorrect, defective, or damaged product;

  • The customer is generally responsible for return costs involving size selection, fit, preference, change of mind, or another reason not caused by SE.

Approved refunds are issued to the original payment method.

After the refund has been processed by SE, it generally takes 3 to 5 business days to appear in the customer’s account. Banks and payment providers may require additional time.

The complete Return & Refund Policy should be reviewed before placing an order.

20. Promotions and Discount Codes

Promotions, discounts, coupons, gifts, and special offers may be subject to additional terms.

Unless otherwise stated:

  • Offers cannot be combined;

  • Discounts have no cash value;

  • Promotions may be limited by date, product, region, or quantity;

  • Discount codes must be entered before checkout is completed;

  • Promotions cannot be applied retroactively;

  • Promotional items remain subject to availability.

We may cancel or modify a promotion where necessary to correct errors, prevent abuse, address fraud, or comply with law.

We may refuse promotional benefits obtained through manipulation, duplicate accounts, automated systems, or other misuse.

21. Gift Cards and Store Credit

Gift cards and store credit, when available, are subject to the terms presented at the time of issuance.

Unless required by law:

  • Gift cards cannot be exchanged for cash;

  • Store credit may only be used through the SE store;

  • Promotional credit may expire;

  • Lost or stolen codes may not be replaceable;

  • Credit cannot be transferred without authorization.

Statutory gift-card rights applicable in your jurisdiction remain unaffected.

22. Customer Accounts

Certain Services may allow you to create an account.

You are responsible for:

  • Maintaining accurate account information;

  • Protecting your password;

  • Restricting access to your account;

  • Reviewing activity performed through your account;

  • Notifying us of suspected unauthorized access.

You must not create an account using another person’s identity or information without authorization.

We may suspend or close an account that is fraudulent, abusive, inactive, unlawful, or in violation of these Terms.

23. Reviews and User Content

You may be able to submit reviews, photographs, videos, comments, suggestions, feedback, or other content referred to as “User Content.”

You retain ownership of your User Content. However, by submitting it, you grant SE a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from that User Content for purposes including:

  • Operating the Services;

  • Marketing products;

  • Advertising;

  • Social media;

  • Customer support;

  • Business improvement.

You represent that:

  • You own or are authorized to submit the content;

  • The content is accurate and not misleading;

  • The content does not infringe third-party rights;

  • The content does not contain unlawful, defamatory, threatening, obscene, fraudulent, or malicious material;

  • Any required disclosure concerning compensation or free products has been made.

We may remove or decline to publish User Content that violates these Terms or applicable law.

We are not required to keep User Content confidential, compensate you for it, or respond to it.

24. Intellectual Property

All content made available through the Services, including:

  • Brand names;

  • Logos;

  • Designs;

  • Product photography;

  • Videos;

  • Graphics;

  • Text;

  • Product descriptions;

  • Website layouts;

  • Software;

  • Icons;

  • Illustrations;

  • Marketing materials;

is owned by, licensed to, or lawfully used by SE and is protected by applicable intellectual-property laws.

You may access the Services for personal, non-commercial shopping purposes.

You may not, without prior written permission:

  • Copy or reproduce website content;

  • Republish product photographs or descriptions;

  • Use SE trademarks or branding;

  • Scrape or systematically collect data;

  • Reverse engineer website functionality;

  • Create derivative commercial materials;

  • Resell, license, or exploit website content;

  • Use our content in misleading advertisements.

No license or ownership right is transferred to you except as expressly stated.

25. Intellectual-Property Complaints

If you believe that content available through the Services infringes your copyright, trademark, or other intellectual-property rights, contact:

By using the Services, you acknowledge that personal information may be processed by SE, Shopify, payment providers, shipping carriers, fraud-prevention services, and other providers involved in operating and fulfilling the Services.

30. Electronic Communications

By using the Services or communicating with us electronically, you consent to receive communications concerning:

  • Orders;

  • Payments;

  • Shipping;

  • Returns;

  • Accounts;

  • Customer support;

  • Security;

These communications may be delivered by email, account notification, website notice, or another electronic method.

Where you separately consent to promotional communications, you may unsubscribe using the instructions included in those messages.

Unsubscribing from marketing does not prevent us from sending transactional or legally required communications.

This obligation does not apply where prohibited by applicable consumer law.

  • Flood;

  • Epidemics or pandemics;

  • War;

  • Terrorism;

  • Civil unrest;

  • Import or export restrictions;

  • Supply-chain disruptions.

We will make reasonable efforts to minimize the effect of such circumstances.

35. Termination

These Terms remain effective until terminated by you or SE.

You may stop using the Services at any time.

We may suspend or terminate access if we reasonably believe that you:

  • Violated these Terms;

  • Used the Services fraudulently;

  • Created a security risk;

  • Violated applicable law;

  • Harmed SE, customers, Shopify, or third parties.

Termination does not affect rights or obligations that arose before termination.

Sections concerning payment, intellectual property, disclaimers, liability, indemnification, disputes, and other provisions intended to survive will remain effective.

36. Severability

If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will remain valid and enforceable.

37. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver is only effective when expressly provided in writing by an authorized representative of SE.

38. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, financing, sale of assets, corporate reorganization, or transfer of the business, subject to applicable law.

39. Entire Agreement

These Terms, together with our:

  • Privacy Policy;

  • Return & Refund Policy;

  • Shipping Policy;

  • Other policies or notices published on the website;

constitute the entire agreement between you and SE concerning your use of the Services and your purchases.

If a conflict exists between these Terms and a specific policy concerning a particular matter, the more specific policy will apply to that matter.

40. Governing Law

These Terms and any transaction involving SE will be governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be submitted to a court of competent jurisdiction located in Delaware, unless applicable consumer law gives you the right to bring a claim in another jurisdiction.

Nothing in this section limits mandatory consumer rights or legal protections available in the country, state, province, or territory where you reside.

41. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact us at support@sebrand.us and provide a reasonable opportunity to investigate and resolve the dispute.

The notice should include:

  • Your name;

  • Order number, when applicable;

  • A description of the issue;

  • Supporting documents;

  • The resolution requested.

We will make reasonable efforts to resolve legitimate disputes in good faith.

This informal process does not prevent either party from seeking urgent legal relief or exercising rights that cannot be restricted by agreement.

42. Consumer Rights

These Terms do not limit any consumer rights that cannot be waived or excluded under applicable law.

Customers in certain countries or regions may have mandatory rights concerning:

  • Product conformity;

  • Cancellations;

  • Returns;

  • Refunds;

  • Warranties;
